In consideration of Shoreline Inclusive Camping furnishing services and/or camping facilities and/or equipment to enable me to participate in canoeing, tubing, kayaking, camping or other recreational activities I agree as follows:

 

I fully understand that there are risks, hazards and dangers associated with the services and activities provided by Shoreline Inclusive Camping.  These risks include the uncertainties of the river or of the weather, hazards in the river, collisions while traveling by vehicle or on the river, altercations with other people on the river, including altercations with other participants in the same activity, and with the uncertainty of conditions in and outdoor environment.  I understand that the description of these risks is not complete and that other unknown or unanticipated risks may result in injury or death.  I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITES AND AM USING THE SERVICES OF DAN RIVER CAMPGROUND WITH FULL KNOWLEDGE OF THE RISKS INVOLVED AND I ACCEPT AND ASSUME ALL RISK OF THE ACTIVITES AND SERVICES WHETHER OR NOT DESCRIBED ABOVE, KNOWN OR UNKNOWN, FORESEEABLE OR UNFORESEEN.  I UNDERSTAND THAT THESE RISKS MAY INCLUDE LOSS OF PROPERTY OR INJURY TO PERSON OR DEATH.

I agree for myself and for all minors for whom am parent or guardian for my heirs, successors and assigns, that I release Shoreline Inclusive Camping, it’s owners, agents and employees from any and all claims, damages, and injuries, including all injuries to person or to property, arising directly or indirectly out of the activities or services provided by Shoreline Inclusive Camping.

This release and the following indemnification includes any claims arising, in whole or in part from negligent acts or omissions of Shoreline Inclusive Camping, it’s owners, agents or employees.

 

I agree for myself and for all minors for whom I am parent or guardian, for my heirs successors and assigns, that I shall defend, indemnify and hold harmless Shoreline Inclusive Camping, it’s owners, agents and employees from all losses, claims, expenses and demand, including attorney fees, that may be incurred by Shoreline Inclusive Camping, it’s owners, agents and employees, that are related, directly or indirectly , to my, or any minor for whom I am parent or guardian, use or participation in the services or activities provided by Shoreline Inclusive Camping.

I HAVE CAREFULLY READ, CLEARLY UNDERSTAND AND VOLUNTARILY SIGN THIS PARTICIPATION, RELEASE AND INDEMNIFICATION AGREEMENT.  I INTEND BY SIGNING THIS AGREEMENT TO INDUCE SHORELINE INCLUSIVE CAMPING TO PROVIDE SERVICES AND ACTIVITIES.

WAIVER AND RELEASE OF LIABILITY AGREEMENT

  1. DISCLAIMER

This Waiver and Release is applicable to all renters, operators, passengers, and users of equipment

provided by Shoreline Inclusive Camping. *(For purposes of this Waiver and Release, the term “Shoreline Inclusive Camping” includes all employees, agents, representatives, servants, assigns, successors, insurers

and subsidiaries of Shoreline Inclusive Camping). If any other rental agreement is used in addition to, or in conjunction with, this Release, the provisions of this Release shall prevail over any other clauses in the rental agreement that are inconsistent with this Release. The undersigned agrees that he/she is also signing this Release on behalf of undersigned’s minor children. Renter agrees that he/she will disclose to Shoreline Inclusive Camping all potential operators, passengers, and users of said rental equipment.

Renter further agrees that in the event that he/she fails to notify Shoreline Inclusive Camping of all potential operators, passengers, or users of said equipment, he/she will be personally liable for any damages to the undisclosed individuals, even if such damages arise out of the negligence or fault of

  1. EXPRESS ASSUMPTION OF RISK

The undersigned hereby agrees that he/she is renting, operating or using the equipment provided by

Shoreline Inclusive Camping at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, and assumes all risk of injury, illness, damage or loss that might result, even if the risks arise out of the

negligence or fault of Shoreline Inclusive Camping. Initials:__________

III. WAIVER/RELEASE OF LIABILITY

By the execution of this Release, the undersigned agrees that Shoreline Inclusive Camping shall not be liable for any damages arising from personal injuries sustained by the undersigned or any minor children under the undersigned’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Shoreline Inclusive Camping. The undersigned assumes full responsibility for any such injuries or damages which may occur, and further agrees that Shoreline Inclusive Camping shall not be liable for any loss or theft of personal property. The undersigned specifically

agrees that Shoreline Inclusive Camping shall not be responsible for such injuries, damages, loss or

theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY ADVENTURE BOAT RENTALS,

whether such negligence is present at the signing of this Release or takes place in the future. This

Waiver and Release does not apply to gross negligence or intentional torts by Shoreline Inclusive Camping.

The undersigned hereby agrees that he/she will indemnify and hold harmless Shoreline Inclusive Camping for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and minor children under the

undersigned’s custody, care, and control, as a result of any and all activities related to the rental,

operation, or use of equipment provided by Shoreline Inclusive Camping, even if such damages arise out

of the negligence or fault of Shoreline Inclusive Camping. Initials:___________

  1. ACKNOWLEDGMENT OF WAIVER AND RELEASE

The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions associated with said Release. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Shoreline Inclusive Camping with the knowledge that signing this Release is a requirement for rental, operation, and use of said equipment.
